CareCalendar Terms of Service
These Terms of Service are a legal agreement between you and CareCalendar. By creating an account or using the Service, you agree to abide by these Terms. If you do not agree, please do not use the Service.
1. Introduction
Welcome to CareCalendar, a co-parenting scheduling application (the "Service"). These Terms of Service ("Terms") are a legal agreement between you (the user) and the Service provider (referred to as "Company," "we," or "us"). By creating an account or using CareCalendar, you agree to abide by these Terms. If you do not agree, please do not use the Service. We reserve the right to update these Terms from time to time, and will notify you of material changes (e.g., via app or email). Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
2. Eligibility and User Accounts
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a CareCalendar account. The Service is intended for use by adult parents or legal guardians and authorised collaborators in a child's care. Minors (children under 18) are not permitted to create accounts on CareCalendar, and the Service is not directed to children. Any Teen/Child user access is view-only and must be set up and supervised by a parent/guardian. By using the Service, you represent that you are legally capable of entering into this agreement and that all information you provide to us is accurate and up-to-date.
Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to use strong passwords and to notify us immediately of any unauthorised access or security breach. You may sign up using email/password or supported single sign-on methods (e.g. Apple or Google). You must provide a valid email address and any other information required during registration, and keep your contact information current. Each user may only create an account for themselves; account sharing is not permitted. We may suspend or terminate accounts that violate these Terms or where we suspect unauthorised use.
3. User Roles and Responsibilities
CareCalendar supports different user roles with varying permissions, as described below. You agree to use the Service only in accordance with your role and its intended capabilities:
Parents/Guardians (Primary Users)
Parents or legal guardians are the primary users with full read/write access within their family group. As a Parent/Guardian, you can create a family profile, add your children's information, manage and edit schedules, propose or approve schedule changes (swaps), upload attachments (e.g. documents), and invite other authorised users (such as the co-parent). You are responsible for ensuring that any co-parent or alternate caregiver you invite is authorised and informed about these Terms. You also agree to only input information about a child that you have the legal right to share (e.g., you are the parent or have legal permission).
Alternate Caregivers
(Planned Future Feature) These are users like grandparents, babysitters, or others you designate, who may have limited access. An Alternate Caregiver might only see certain calendar events, receive reminders, or add pickup/drop-off notes. If you invite an Alternate Caregiver, you are responsible for what information they can access and you must ensure you have consent to share the child's schedule with them. Alternate Caregivers must also abide by all applicable terms and keep information confidential.
Teen/Child View-Only Access
(Planned Future Feature) In the future, we may allow a teen or older child to have view-only access to their schedule. Such access will only be enabled with parental consent and under a parent/guardian's account controls. As minors cannot independently create accounts, the parent/guardian is responsible for any use of the Service by their child.
Mediator/Caseworker Access
(Planned Future Feature) In some cases, with your consent, a neutral third-party such as a family mediator or caseworker may be given read-only access to the family's calendar and audit logs. This could be via a special web dashboard for professionals. Mediators/Caseworkers will not modify data but can view schedules and history to assist in dispute resolution. If this feature is used, all parties in the family will be made aware that a mediator is viewing the information.
Your Responsibilities
All users, regardless of role, agree to use the Service for its intended purpose of facilitating scheduling and communication in co-parenting. You are responsible for all content you enter into CareCalendar (including calendar events, messages, files, and information about you or your children). You must ensure that: (a) the information is accurate and kept updated; (b) you have the rights or permissions needed to input or share the information (especially personal data of children or other individuals); and (c) your use of the Service complies with all applicable laws and court orders (for example, custody agreements or privacy laws). You must not rely on CareCalendar as a substitute for any legal process – it is a tool to assist you, but any formal modifications to custody arrangements or schedules may still require legal approval.
4. Services, Subscription and Fees
Free Tier
CareCalendar may offer a free tier of service with core features available to all registered Parent/Guardian users. This free service allows you to create a family calendar, add events and notes, and use basic scheduling tools. We reserve the right to limit certain features or usage (for example, number of families or stored attachments) for free-tier users.
Subscription Plans
In addition to the free tier, we may offer premium features or expanded usage limits through paid subscription plans. Subscription details (such as pricing, billing interval, and included features) will be provided at the time you choose to subscribe. By purchasing a subscription, you agree to pay the applicable fees and taxes and to the billing terms presented to you at the time of purchase. If you subscribe through a mobile app store (e.g. Apple App Store or Google Play Store), the payment and refund terms of that platform may apply in addition to our Terms.
Billing and Renewal
Subscription fees will be charged on a periodic basis (e.g., monthly or annually) as per the plan you select, and will automatically renew at the end of each billing period unless you cancel beforehand. You authorise us (or the app store platform) to charge your chosen payment method for each renewal until you cancel. You can cancel a subscription at any time; however, prepaid fees are non-refundable except where required by law or explicitly stated otherwise.
Changes to Fees
Our fees and subscription plans may change over time. If we introduce new fees or change existing fees, we will give you reasonable advance notice by email or through the Service. Fee changes will not apply retroactively and, for subscribers, will generally take effect at the start of your next billing cycle.
5. Acceptable Use Policy
By using CareCalendar, you agree to the following acceptable use terms. These rules are in place to ensure a safe, lawful, and respectful environment for all users. You must NOT:
- Violate Laws or Rights: Do not use the Service for any unlawful purpose or in violation of any local, state, national, or international laws. This includes not posting or sharing any content that is defamatory, harassing, threatening, or that infringes someone else's privacy or intellectual property rights.
- Interfere with the Service: Do not attempt to disrupt, degrade, impair, or violate the integrity or security of the Service. This means you will not attempt to hack the Service, introduce malware or harmful code, bypass any access restrictions, or otherwise interfere with other users' experience.
- Misuse Personal Data: Do not use information obtained from CareCalendar for any purpose outside of co-parenting and personal scheduling. Personal data accessed through the Service should be treated as confidential.
- Upload Prohibited Content: You are responsible for all content you upload or submit. You agree not to upload or transmit any content that is offensive, obscene, or pornographic, or that contains violent or graphic images inappropriate for a family context.
- No Abuse or Harassment: The Service should not be used to harass, abuse, or surveil others. You must not use calendar entries, messages, or any feature to threaten, insult, or demean your co-parent or any other person.
Enforcement
We reserve the right (but do not have the obligation) to monitor use of the Service and content posted to ensure compliance with this Acceptable Use Policy. We may remove any content that we, in our sole discretion, deem to violate these Terms or applicable laws. We may also suspend or terminate accounts for violations.
6. User Content and Data Ownership
Your Content
You retain ownership of all content you submit to CareCalendar, including schedule information, messages, photos, attachments, and any other data related to your family (collectively, "User Content"). We do not claim ownership of your User Content.
License to Us
When you upload or share User Content on CareCalendar, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify (e.g., for technical processing like formatting data for display), and transmit that content solely for the purpose of operating the Service and fulfilling the features you are using. We will never use your content for marketing or advertising without your explicit consent.
Data Accuracy
You are responsible for the accuracy of the data you input. We are not liable for any consequences that arise from incorrect or outdated information you or another authorised user provide.
7. Privacy and Data Protection
Your privacy is extremely important to us. By using CareCalendar, you also agree to the terms of our Privacy Policy. We collect and use personal information primarily to provide the Service. We implement industry-standard security measures to protect your data, including encryption in transit (TLS 1.2+) and encryption at rest. We comply with applicable data protection laws, including the Australian Privacy Act 1988, EU's GDPR, and California's CCPA to the extent they apply.
8. Disclaimers of Warranty
CareCalendar is provided on an "as is" and "as available" basis. While we strive to offer the best possible service, we do not guarantee that the Service will meet all of your expectations or requirements, or that it will be uninterrupted, error-free, or always secure. Use of the Service is at your own risk. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory.
9. Limitation of Liability
Indirect Damages
To the maximum extent permitted by law, in no event will the Company be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) CareCalendar.
Direct Damages Cap
To the extent we are found liable for any claim, our liability to you for all claims arising in any 12-month period will not exceed the total amount you have paid us for the Service in that period (or, if you have not paid us, the amount of AUD $100.00).
Indemnification
You agree to indemnify and hold the Company harmless from and against any loss, liability, claim, demand, damages, or expenses arising out of or related to your violation of these Terms or misuse of the Service.
10. Dispute Resolution
We encourage you to contact us first if you have any issues with the Service, as many disputes can be resolved informally. If a dispute arises that cannot be resolved through customer support communications, both parties agree to consider mediation in good faith.
Court Litigation
Any judicial action will take place in the courts of competent jurisdiction in the State of Queensland, Australia. Both you and the Company consent to venue and personal jurisdiction in Queensland.
11. Governing Law and International Compliance
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia and the state laws of Queensland, without regard to its conflict of law principles. We recognise and comply with global data protection regulations including GDPR and CCPA as applicable.
12. Termination of Access
By You
You may stop using CareCalendar at any time. You may also delete your account by following the instructions within the app or by contacting support.
By Us
We reserve the right to suspend or terminate your access to the Service at our discretion if you violate these Terms or if we have a good-faith belief that such action is necessary to protect the security, integrity, or reputation of the Service or other users.
13. Changes to These Terms
We may modify or update these Terms from time to time to reflect changes in our Service, technology, legal requirements, or for other reasons. When we update the Terms, we will provide notice through the Service. By continuing to use the Service after new Terms become effective, you agree to the revised Terms.
14. Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Service. If any provision is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision will not be deemed a waiver. You may not assign these Terms without our prior written consent.
